The client turned to ARROWS when false claims began circulating about his company regarding alleged breaches of contractual obligations and the quality of services provided. The claims appeared online and were simultaneously directed at selected business partners of the client, creating a risk of loss of trust, reputational damage, and disruption of ongoing business negotiations. As a first step, ARROWS therefore secured evidence of the disputed statements, legally assessed their nature, and prepared a strategy for rapid out-of-court intervention, supplemented by a readiness to file a motion for preliminary injunctive relief should the opposing party continue its actions. This approach was the most appropriate in this case because reputational damage must be addressed immediately—a traditional defamation lawsuit would have been too slow on its own.
ARROWS subsequently drafted a pre-litigation demand, communicated with the opposing party and online platform operators, and simultaneously developed legal arguments for potential litigation. The focus was on removing the false claims, halting their further dissemination, issuing a corrective statement, and securing contractual guarantees to prevent similar incidents from recurring. The result was the removal of the offending content, the cessation of further communications damaging the client, and the conclusion of an agreement that provided the client with swift and practically enforceable protection without the need to engage in a lengthy reputation dispute in court.
