Successful amendment to the zoning plan for a development project

The client approached ARROWS at a stage when it owned land suitable for a development project, but the land use designation under the current zoning plan did not align with the planned construction. ARROWS first conducted a legal analysis of the existing zoning documentation, identified the land use restrictions, and assessed whether it would be more appropriate to seek a zoning plan amendment or to adapt the project to existing regulations. The option of initiating a zoning plan amendment, supplemented by a substantively prepared justification of the project’s public and infrastructure acceptability, was selected as the most suitable, as only this approach allowed the project to be implemented to the necessary extent while simultaneously reducing the risk of future objections.
ARROWS subsequently prepared the legal portion of the proposal to amend the zoning plan, coordinated communication with the municipality, the zoning plan designer, and other advisors, and participated in establishing the terms of cooperation between the investor and the local government. The solution also included addressing the investor’s legal obligations related to transportation and technical infrastructure so that the amendment would not be perceived solely as a unilateral private interest, but as a balanced development project. The result was the approval of the zoning plan amendment, the removal of a key legal obstacle to the project, and the creation of a stable foundation for the next phase of development.
